Terms and Conditions for the Mumio webshop

1. Introduction

1.1 Scope of the Terms and Conditions

The general terms and conditions (hereinafter referred to as T&Cs) apply to the use of the website www.mumio.ch as well as to all orders and deliveries of Shilajit and other offers on the website that are made via the website. Deliveries and orders are made exclusively under the conditions of these general terms and conditions in the version valid at the time the contract is concluded.

1.2 Contracting Parties

The provider of the website (hereinafter referred to as the provider) is Mumio KLGg.

A customer/consumer (hereinafter referred to as customer) is any natural person who concludes a legal transaction for a purpose that cannot be attributed predominantly to their commercial or independent professional activity. Orders in quantities that are not usual for households can be rejected without justification.

The offer is aimed at customers in Switzerland and selected countries.

1.3 Contract language

The contract can be concluded in German or English. Regardless of the language chosen, Swiss law applies (see section 112.23).

1.4 Agreement to the Terms and Conditions

By using the website and ordering products, the customer agrees to these terms and conditions.

2. Conclusion of contract

2.1 Products in the online shop

The presentation and all information about the products in the online shop does not constitute a legally binding offer, but serves as an illustration. It is a non-binding invitation to order the goods.

2.2 Minimum order value

There is a minimum order value of CHF 90.90 per order. The minimum order value is shown during the ordering process. If a discount is granted, the minimum order value can be adjusted according to the discount granted.

2.3 Binding offer of the customer

By submitting the order form via the website and accepting the terms and conditions during the ordering process, the customer makes a binding offer to conclude a contract. The customer then receives an automatic order confirmation by email confirming receipt of the order. Orders are therefore binding for the customer.

There is no right of return or withdrawal unless expressly stated otherwise.

2.4 Conclusion of the contract

The contract is definitely concluded when the provider accepts the customer's binding offer. The provider sends the customer a declaration of acceptance by email, confirming the dispatch of the ordered products.

The provider reserves the express right to reject orders in whole or in part without stating reasons. The customer will be informed of the rejection and any payments already made will be refunded. Further claims are excluded.

2.5 Availability and delivery

Orders will only be delivered after full payment has been received and provided the goods are available. If it turns out that ordered goods are not available or only partially available, the provider is entitled not to accept or execute the order or to only partially accept it. In such a case, the customer will be informed by email. Payments already made will be refunded if the order cannot be fully fulfilled.

3. Prices and payment terms

3.1 Prices and currencies

The purchase prices stated on the website are final prices in Swiss francs (CHF). Unless otherwise stated, they include the statutory value added tax and any other statutory duties. The price stated on the website at the time of the order is decisive.

The prices indicated on the website do not include shipping costs or consulting and support services.

3.2 Shipping costs

Shipping costs are generally not included in the item price on the website. Shipping costs are calculated based on the order quantity, weight and size of the order and are to be borne by the customer. The amount of the shipping costs is shown during the ordering process and is binding.

3.3 Price changes

The provider reserves the right to make price changes at any time and without prior notice. Technical changes, errors and misprints remain reserved.

3.4 Payment options

Basically, the following payment options are offered: credit card, Twint and payment in advance.

The provider expressly reserves the right to change and add to the payment options offered. The current possible payment options are visible to the customer during the ordering process. The customer has the right to choose the payment method during the ordering process.

The provider assumes no liability for payment problems in connection with the choice of a payment option.

3.5 Exclusion of certain payment options

The provider reserves the right to exclude customers from certain payment options without giving reasons or to demand payment exclusively in advance.

4th delivery

4.1 Delivery times

The delivery times are stated on the website. The provider will endeavour to adhere to the stated delivery times, but these are not binding. No liability is accepted for longer delivery times.

For urgent orders, we recommend that you clarify this with the provider in advance via email.

4.2 Delivery conditions

Deliveries are made by post or courier to the address specified by the customer in the order. Deliveries are only made to addresses provided on the website.

The order is generally sent in one delivery. However, the provider reserves the right to make partial deliveries; in this case, the customer will only be charged the shipping costs once.

The delivery is generally dispatched within 5 working days. The shipment is made using the selected shipping method (A-Post or B-Post). The general terms and conditions of the Swiss Post or the selected courier service apply to the shipment.

5. Retention of title

The goods remain the property of the provider until full payment has been made.

6. Deliverability and refusal of acceptance

If the delivery cannot be made or the customer refuses to accept it, the provider can terminate the contract after notification by email and a reasonable grace period and invoice the customer for the costs of the effort. The provider's right to fulfill the purchase contract remains unaffected.

7. Right of withdrawal

There is no right of cancellation. However, if there is a problem with the order, you can contact the provider's customer service. There is no right to demand concessions from the provider. However, the provider will endeavor to offer a satisfactory solution for the customer.

It is the customer's responsibility to carefully check whether he wishes to order the desired products before executing the binding order.

8. Warranty and Liability

8.1 Warranty claim

The customer must check the delivered products for completeness, correctness and delivery damage immediately after receipt. Defects or incorrect deliveries must be reported to the provider in writing immediately, but no later than 5 days after receipt of the goods. The defective goods must then be returned to the provider. The customer is responsible for the return costs. Postage paid by the customer for returns will not be refunded.

In the event of defects in the delivered goods or incorrect deliveries, a warranty is valid after the customer has returned the goods. The warranty is provided at the provider's discretion in the form of a defect-free subsequent delivery or the release of the customer from the contract and reimbursement of the purchase price paid. Further warranties are excluded.

8.2 Disclaimer

The provider excludes any liability, regardless of its legal basis, as well as claims for damages against the provider and its assistants. In particular, the provider is not liable for damages caused by improper use of the purchased goods, nor for indirect damages, consequential damages, lost profits or other personal, material and financial damages to the customer. Further legal liability remains reserved.

9. Data Protection

The privacy policy is an integral part of the General Terms and Conditions. By accepting the General Terms and Conditions, the customer also agrees to the privacy policy.

9.1 Data Protection Policy

The provider may use the data collected during the conclusion of the contract to fulfill the contractual obligations and for marketing purposes. The data necessary to fulfill the service may also be passed on to service partners (e.g. logistics partners) or third parties.

9.2 Purpose of data processing

The data will be used by the provider exclusively to process the order and to improve the customer experience.

9.3 Customer rights

The customer has the right to information, correction, blocking and deletion of his stored data at any time.

10. Rights of Use

10.1 Copyrights and intellectual property

All content on the website, including texts, images and graphics, is protected by copyright.

10.2 Use of the contents of the website

The contents may not be reproduced, distributed or otherwise used without the express written permission of the provider.
