Terms and Conditions for the Mumio Webshop
1. Introduction
1.1 Scope of the Terms and Conditions
These General Terms and Conditions (hereinafter T&Cs) apply to the use of the website www.mumio.ch as well as for all orders and deliveries of Shilajit and other products offered via the webshop.
All deliveries and orders are exclusively subject to the T&Cs in the version valid at the time of contract conclusion.
1.2 Contracting Parties
The provider of the website (hereinafter Provider) is Mumio KLG.
A customer is any natural person who enters into a legal transaction that is predominantly not attributable to their commercial or independent professional activity. Orders exceeding customary household quantities may be rejected without stating reasons.
The offer is directed at customers in Switzerland and selected other countries.
1.3 Contract Language
The contract can be concluded in German or English. Regardless of the chosen language, Swiss law applies.
1.4 Acceptance of the T&Cs
By using the website and placing an order, the customer agrees to these T&Cs.
2. Conclusion of Contract
2.1 Products in the Online Shop
Product representations and information in the webshop do not constitute a legally binding offer. They are for illustration purposes only and are non-binding invitations to order.
2.2 Minimum Order Value
The minimum order value is CHF 90.90. This will be shown during the ordering process. For granted discounts, the minimum order value may be adjusted accordingly.
2.3 Binding Offer from the Customer
By submitting the order and confirming the T&Cs, the customer makes a binding offer to conclude a contract.
The customer receives an automatic order confirmation by e-mail. This merely confirms receipt, but not acceptance, of the order.
There is no right of return or withdrawal unless expressly stated.
2.4 Formation of the Contract
The contract is only concluded upon acceptance of the offer by the Provider. This is done by a shipping confirmation via e-mail.
The Provider may reject orders at any time and without giving reasons. Payments already made will be refunded. No further claims exist.
2.5 Availability and Delivery
Orders will only be delivered after receipt of payment and only if the goods are available.
If a product is not or only partially deliverable, the customer will be informed by e-mail. Payments already made will be refunded accordingly.
3. Prices and Payment Terms
3.1 Price Information and Currencies
All prices are final prices in Swiss Francs (CHF) and include – unless otherwise stated – the statutory value-added tax.
Shipping costs and support services are not included.
3.2 Shipping Costs
Shipping costs are calculated during the ordering process based on the number of items, weight, and package size and are binding.
3.3 Price Changes
The Provider reserves the right to change prices at any time. Technical changes, errors, and misprints are reserved.
3.4 Payment Options
The following payment methods are generally available:
-
Credit card
-
Twint
-
Prepayment
The Provider may adjust the available payment methods at any time.
Liability claims in connection with the chosen payment method are excluded.
3.5 Exclusion of Certain Payment Methods
The Provider may exclude customers from individual payment methods or demand prepayment without giving reasons.
4. Delivery
4.1 Delivery Times
Delivery times are indicated on the website but are non-binding.
No liability is assumed for delays. Urgent orders should be clarified in advance by e-mail.
4.2 Delivery Conditions
Delivery is made by post or courier to the address provided by the customer.
The Provider may make partial deliveries. Shipping costs will only be charged once in this case.
Shipping is handled according to the terms of the respective shipping service provider.
5. Retention of Title
The goods remain the property of the Provider until full payment.
6. Deliverability and Refusal of Acceptance
If a delivery is undeliverable or refused, the Provider may, after notification and setting a deadline, withdraw from the contract and charge the customer for incurred costs.
7. Right of Withdrawal
There is no right of withdrawal.
In case of problems, the customer can contact customer service. There is no entitlement to goodwill, but the Provider strives for a customer-oriented solution.
The customer is responsible for carefully checking their order before submitting it.
8. Warranty and Liability
8.1 Warranty Claim
The customer must inspect the goods immediately upon receipt. Defects must be reported in writing within 5 days.
Return shipping costs are borne by the customer.
The Provider provides a warranty through replacement delivery or refund of the purchase price. Further warranty claims are excluded.
8.2 Disclaimer of Liability
The Provider excludes all liability – especially for improper use, indirect damage, consequential damage, and lost profits.
Statutory liability remains reserved.
